Today’s issue of the Italian Newspaper, La Verità, contains a Front Page advertisement for the perpetual novena to Our Lady of Santa Maria Maggiore, with an invitation for all to follow on Youtube, where they can find more information.

Many thanks to the Editors of La Verità who graciously permitted a religious advertisement in their newspaper, something which most newspapers in Italy do not tolerate, since they are controlled by political interests which are opposed to the Catholic Faith.

Italian Premier shuts down Italy completely as of today

A lawyer who never was elected to any office in the Italian Republic: Giuseppe Conte, the President of the Council of Ministers, or what in the English speaking world would be called the Prime Minister, has decided that for the safety of Italy, that everything in the country should be shut down as of today, March, 12, 2020, except for supermarkets, pharmacies, newspaper stands and public transport.

He announced his dictatorial decree on FaceBook of all things! So reports, Il Tempo, one of the major Italian Daily Newspapers online.

Here is a man whom one Italian told me is a true ignorante (ignoramus). Another called him an insensato, that is, someone who has lost all common sense.

The Corona virus 19, which is simply a new form of corona virus already known to mankind is not a lethal plague.  Attorney Christopher Ferrara explained it well in his article at The Remnant: it is a minor health issue blow up into mega proportions for the maximum political effect.

More people die each month from influenza than have ever died from Corona virus 19.

I suppose by the time I wake up, Giuseppe Conte will have next decreed that we should all stop breathing, so to guarantee that no one else gets infected!

If there is any doubt that some politicians are using Corona virus as an excuse to seize unheard of dictatorial powers that border on the divinity, Conte has just proven them right. Conte, has not repented, he is heading at full speed to a dark end, as I wrote of the other day. He does not have the basic competence to govern.

Let us pray the Lord Jesus, that He protect His people from this kind of maniac.

Saint Alphonsus: When it is morally licit to receive the Sacraments from unworthy ministers?

Many Catholics, who remain in communion with Pope Benedict, but have no clergy in their area who do so, ask me whether it be morally licit for them to receive the Sacraments from these clergy. I also get this question from Catholics who live in the Mid-East, where many Catholics receive the Sacraments in both the Catholic and the Orthodox Churches, which for long centuries have not been in communion with the Apostolic See.

Here I will present the doctrine of the Doctor of the Church, Saint Alphonsus dei Liguori, C.Ss.R., from his Theologia Moralis, by citing what he says on diverse questions. The Roman Church, by raising Saint Alphonsus dei Liguori to the dignity of a Doctor of the Church in questions of moral theology, gives at least a tacit approval to those opinions. This does not mean that they are the teaching of the Church or that they are, by that fact alone, opinions which form part of the ordinary magisterium. But it is a strong indication that if the Church ever judge such questions, that she will likely side with the opinions of the Saint, even though on one of his opinions, She has expressly withdrawn her approval — I am told.*

Here is Saint Alponsus teaching, which regards clergy who are public sinners or excommunicated or under some censure. He does not speak of heretics, of whom it is the teaching of the Church at all times, that we cannot receive any Sacrament from condemned heretics.

n. 88 — There is asked 2nd.: Whether it be licit to receive the Sacraments from an unworthy minister? — Here it is necessary to distinguish between a minister who is unworthy because of some censure and/or inability, and a minister and one unworthy because of mortal sin.

I respond 1st.: If a minister is unworthy through a censure etc., and is not to be tolerated, most of all if he be excommunicated as one to be avoided and/or publicly and by name suspended, or irregular through a judicial sentence, certainly it is not licit to seek the Sacraments from him, except in extreme and/or in the greatest of necessity in which all say it is licit to receive Baptism and Penance … {Editor’s note: here follows a citation of authorities from whom the Saint drew his opinion. I will omit these in this translation with the symbol …}.

Likewise, probably also the Sacrament of the Eucharist as say … . And adhering to this opinion is Tournely, who citing Pope Innocent III, in Gratian, chapter Quod in te, de poenitent. et remission, who though he denied Extremunction to the dying in the time of a general interdict, did not deny Penance and Viaticum.

Likewise, concerning the Sacrament of Extremunction think … by this that such a Sacrament can be the cause of grace. But better do those not admit this with … except when the infirm is not able to receive any other sacrament.

Equally, say … that it is licit to receive the Sacrament of Orders from a Bishop who is excommunicated, when in some remote province, he alone can be found, and such an ordination redounds to the common good.

Likewise, the aforesaid authors say regarding the Sacrament of Matrimony, in the case in which it would be necessary either for the spiritual salvation of one who is dying and/or for the great temporal utility of the children, and when no other minister is at hand.

But whether a  priest who has been excommunicated as one to be avoided can minister the Sacrament of Penance in extreme necessity? This is to be denied, see …

I respond 2nd.:  But if the minister is excommunicated and/or suspended, as one to be tolerated: there is a question among the doctors whether it be licit to receive the Sacraments from him without grave cause. — Some deny this. — But more truly is it to be affirmed, because the Council of Constance conceded in an absolute manner to the faithful that they could receive communion with those to be tolerated. See ….

n.89 — I respond 3rd. But when the minister is unworthy on account of mortal sin, Saint Thomas seems to indistinctly concede that the Sacraments can be received from someone whose sin is hidden from us, saying:  So long as he is tolerated by the Church in ministry, the one who receives the Sacraments from him does not share in his sin. — And the same is had in Gratian, in the chapter, Vestra 7, de cohabitatione clericorum etc., where there is said:  Without a doubt . . . hold that from clerics and bishops, even though they be fornicators, so long as they be tolerated and there not be had evidence of their works (that is, as the Gloss has, they have not been condemend nor have they confessed before the law), the Divine Mysteries are licitly heard and the other Sacraments of the Church are received. But this must be sanely understood, to be valid only to excuse from sin, not to contravene the prohibitions of the Church.

Otherwise, to receive the Sacraments from a sinner, always requires a reasonable cause, in accord with the words in Gratian, Book II, n. 47, v. Secunda et n. 49; and as is otherwise taught by Saint Thomas, where he says: Besides the occasion of necessity, it would not be safe, that he induce him to fulfill anything of his Order, while having such knowledge that that one be in mortal sin.  Moreover, under the name of “necessity” the Continuator of Tournely rightly explains that in this case one is to understand a moral necessity. — Wherefore, to excuse (from sin) there probably also suffices a causae of grave utility; as is most commonly taught by … .

Discussion

As can be seen, Saint Alphonsus speaks of priests who are either public sinners or who have been punished with a decree of excommunication or censure. When he speaks of those to be tolerated, he is referring to the previous discipline, before Vatican II, which distinguished between those who were to be shunned or not to be shunned, on account of the punishment imposed upon them. Holy Mother Church imposed the punishment of shunning, since the time of Saint Paul the Apostle, when She judged that the person was very dangerous or because their conscience required this punishment to bring it back to a right state. In the new Code the punishment of shunning as been abolished, so all excommunicates and censured persons are to be considered to be tolerated, under Saint Alphonsus’ classification.

What is lacking in Saint Alphonsus is any question regarding what is to be done during a schism in the Church.  I think we can extrapolate from the present Code of Canon Law which imposes excommunication upon all schismatics ipso facto, and thus classify them as excommunicated but to be tolerated.

However, the present case of the Bergoglian schism has to do also with public heresy and immorality. And so if the clergy who are schismatic are also heretics, then one should under no condition receive the sacraments from them. The Council of Trent holds as to be excommunicated, also, those who say or teach or practice the giving of the Sacraments of the Eucharist, to those who are public sinners: which certainly applies to the author of Amoris Laetitia and all who accept that doctrine. I would hold such a teaching also to be heretical, but since the Council of Trent did not classify it as heretical, I think we cannot on our own authority regard it as such, until a Council so condemns it.

However, the Bergoglians teach many other heresies. And so the determination if this or that minister is unworthy or not on account of heresy, depends on each individual case of each minister. And in cases in which you do not know if the minster agrees with or accepts any particular heresy, Saint Alphonsus says elsewhere, that you should presume that he is not a heretic.

Regarding, the question of mere schism, however, if a priest has not accepted that Benedict validly resigned, but simply goes by that opinion, he is probably not a formal schismatic, just in error. But if he is shown the evidence that Benedict is still the true pope and examines it, and rejects it publicly or privately to your knowledge, he should be presumed to be formally a schismatic. However, if he refuses consideration without examination, he is more likely just lazy or as of yet psychologically indisposed to consider that such a great lie or error was made, as I was for 6 years. Likewise, if he rejects the arguments that Benedict is still the pope, but does not refuse you the Sacraments, whom he knows publicly or privately to be in communion with Benedict, then he is probably not a formal schismatic, because by his behavior he shows that your opinion is one which can be licitly held.

What Saint Alphonsus does not explain here, is the duty to avoid public scandal. If you are not known to be in communion with the true Pope, and attend the liturgy of schismatics, then no scandal is given, because scandal is only a sin on account of someone knowing of it and being scandalized. But if you are known to be in communion with the true pope and go to the liturgies of Schismatics, and on that account even one poor soul would take scandal and consider it not important for salvation whether they be or not be in communion with the true pope, then you must omit going to those liturgies. Because as Saint Paul teaches in his letters to the Corinthians, we should prefer the salvation of the weak to any desire we have of liberty.

What Saint Alphonsus says here is mostly the repetition of others opinions, though he makes some personal judgement on the questions. However, these principles should be used with prudence and precision, and not taken to be license for the lax or exaggerated in their severity by the super-scrupulous. That is, if you are inclined not to follow rules and do as you please and fudge on definitions of words, then what Saint Alphonsus says should not be interpreted by your conscience, but you should follow the interpretation of a more prudent and upright man of good counsel who respects the Divine and moral law as a minimum duty of every Christians. However, if you are inclined to consider everything a sin or every sin a mortal sin, then you should not follow your understanding of what St. Alphonsus says here, but that of a man with a better understanding of the proper ability to distinguish between what things are and what things might be according to one’s fears.

Finally, what Saint Alphonsus does not discuss is what is the holier or more perfect thing to do. I think that testifying to the truth, right now, in the Church, is a grave necessity for the salvation of all souls. Each of us should do that. How we do it, God leaves to our own initiative. But we should not conceal the truth under a bushel basket, especially on account of only caring for ourselves and the reception of sacraments by ourselves, and not caring for the salvation of priests and our fellow brothers and sisters in the Faith. That is why I write all that I write. And that is why I wrote a Handbook for Converting Priests back to allegiance to Pope Benedict.

That being said, Saint Alphonsus gives us good counsel as to when and under what circumstances we can act without hiding the truth, and avoiding sin, when we have to make personal decisions about receiving the Sacraments.

* I was told by Fr. Alphonsus Sutton, STD, my professor in moral theology, that Saint Alphonsus at one time held that if one intended out of revenge to burn down the house of one’s enemy and by accident and confusion or ignorance burned down the house of someone who was not one’s enemy, that one would not be obliged to pay restitution. That opinion was censured in his own day, and he withdrew it. The Church holds with the Fathers of the Church that restitution must be paid by all in all circumstances when they are the cause of the damage, either directly or by intended that which is its cause, especially in cases of arson.

Palestrina: Missa nigra sum

Today we begin our perusal of the sacred repertoire of  Giovanni Pierluigi da Palestrina, the greatest Italian composer of the 16th century, whose fame has never been extinguished. He came to Rome in 1537, when he began as a cantor at Santa Maria Maggiore, and 14 years later he was in the service of Pope Julius III, who was also from Palestrina.

Today, we sample his Missa nigra sum, a Mass which takes its name from a verse of the Canticle of Canticles, which the Fathers of the Church put in the mouth of Holy Mother Church, in Her dialogue with Christ Her Bridegroom.

What does it mean, “To be loyal to the Pope?”, if we do not care who is the pope?

What does it mean, to be loyal to the Pope,
if we do not consider ourselves obligated
to know who is the true pope?

It is already clear that the whims of politicians has substituted any desire for the truth, and that the Dictatorship of Relativism has exalted itself unto the heavens. Hence, it is necessary duty that we Roman Catholics distinguish now between falsehood and truth.

The criterion of truth differs according to different subjects. In a vote, political truth consists in the final count of the votes. In the empirical sciences, scientific truth consists in what can be observed and demonstrated by repetitive experimentation. In matters of faith, the truth is the teaching which God has revealed. But in questions of who is and who is not the true pope, the truth consists in Canon Law, because the law of the Church regulates whose claim to the papacy is valid and legitimate, and whose is not.

As everyone knows, it is neither whim nor popularity nor a poll which confirms that a man is the Pope. A man becomes pope solely when he is elected in a Conclave. But to be more precise: a man becomes the pope when HE ACCEPTS his canonical election in a legitimate conclave. And a legitimate conclave is a Conclave which observes the papal law of Pope John Paul II, Universi dominici gregis, on the convening of conclaves during a vacancy (sede vacante) of the Apostolic See (see the Latin or English text at Vatican.va).

Obviously, therefore, even if all the Cardinals say the Pope is a man, who was not elected in a conclave which observed the norms of that papal law, he is NOT the pope, because even the Cardinals are obliged to observe the Canon Law of the Catholic Church! In fact, canon 359 says expressly that the Cardinals have no decision making power when the Apostolic See is vacant.

Therefore, to know who is the true pope, it is not sufficient to recognize him who has been elected in Conclave. Every Catholic also has the duty to verify if there was a sede vacante. This, however, is not a problem when a Pope dies, because there is a corpse.

But, how about when a Pope renounces?  There a problem can arise. In fact, Pope John Paul II expressly foresaw the possibility of a invalid renunciation in paragraph 3 of his law on Conclaves, Universi dominici gregis, and indirectly in paragraph, n. 37

Pope John Paul II also foresaw the possibility of an invalid renunciation in the Code of Canon Law which he promulgated in 1983, because in Canon 332 §2, it speaks in these terms regarding a Papal renunciation:

Canon 332 §2 — Si contingat ut Romanus Pontifex muneri suo renuntiet, ad validiatem requiritur ut renuntiatio libere fiat et rite manifestetur, non vero a quopiam acceptetur.

Which in English means:

Canon 332 §2 — If it happen that the Roman Pontiff renounces his munus, for validity there is required that the renunciation be freely made and be duly manifested, but not that it be accepted by anyone whomsoever.

In many translations of this canon, the Latin word munus (which is employed in the dative form, muneri) is translated as office, in accord with the terms of canon 145 §1, which defines every ecclesiastical office (officium) as a munus. This way of translating munus, however, is not faithful, because an ecclesiastical office per se is merely an ecclesiastical dignity. But the munus of the Successor of Saint Peter is a supernatural dignity, an evangelical duty, and a charge imposed by Jesus Himself, by reason of which the law of the Church reckons it as an ecclesiastical office according to the norm of law.

At this point, we need to recognize that in every discussion of canon law, the Latin text of an act is normally the only text which has juridical authority. On this account, Pope Benedict XVI on February 11, 2013, in Consistory with the Cardinals, expressed himself in the Latin tongue, saying in the first person singular (as Joseph Ratzinger) the following:

Quapropter bene conscius ponderis huius actus plena libertate declaro me ministerio Episcopi Romae, Successoris Sancti Petri, mihi per manus Cardinalium die 19 aprilis MMV commisso ​renuntiare ita ut  a die 28 februarii MMXIII, hora 20, sedes Romae, sedes Sancti Petri vacet et Conclave ad eligendum novum Summum Pontificem ab his quibus competit convocandum esse.

A Papal Renunciation is a special kind of juridical act

A papal renunciation of munus is a special kind of juridical act.  As Mons. Arrieta, the Secretary of the Pontifical Council for Legal Texts, in his meeting with Br. Alexis Bugnolo, on December 11, 2019, affirmed, a papal renunciation is not subject to interpretation by anyone, that is, no one in the Church has the legal right to interpret it. Not even the Pope. Because if the renunciation was valid, then he is no longer the pope. And if it was not valid, his interpretation cannot make it valid. “It has to be certain in itself”, as Mons. Arrieta affirmed.

Hence, as can be seen from the official Latin text of the renunciation, quoted above, Pope Benedict XVI renounced the ministerium (ministery). Hence, it is not legitimate for anyone to say that he renounced anything else. In particular, it is not permitted that anyone say that he renounced his munus or ecclesiastical office, for such an affirmation would be an interpretation which substitutes officio (office) or muneri (munus) where Pope Benedict XVI said ministerio (ministry).

Hence, Pope Benedict XVI is still the Pope. There never was a sede vacante.

The Haste and Imprudence of the Cardinals on Feb. 11, 2013 was historic and extraordinary

According to Mons. Arrieta, there never was, as far as he knows, any meeting of expert canonists to examine the Declaratio of Pope Benedict XVI, before Father Lombardi gave the go-ahead to Giovanna Chirri, an ANSA pool report, to tweet out to the world that Pope Benedict had resigned from the papacy.

Obviously, then, no one in the Church is obligated to follow Father Lombardi or Mrs. Giovanna Chirri or even the Cardinals in their error. Rather, we are obliged by the Divine and Catholic Faith to give our loyalty still to Pope Benedict XVI, as the Pope.

Pope John Paul II took precautions against errors of this kind in his Code of Canon Law of 1983, because in that Code, he as the supreme legislator of the Church, changed the canon which regarded the renunciation of the Roman Pontiff. He did this because, for more than 20 years, theologians had put in discussion the possibility of separating the papal government from the papal office, by means of a sharing of the papal dignity among two or more persons, one charged with the papal munus, and the other with the papal ministerium. He put a stop to any such future possibility by adding the words muneri suo as the object of the verb “renuntiare” (to renounce) — the Code of Canon Law of 1917 has no object to the verb.  Moreover, he impeded the possibility of renouncing by renouncing anything else, through canon 188, which declares every renunciation irritus — invalid or never to have existed — which contains a substantial error as regards what is to be renounced.

Thus, even if Pope Benedict XVI wanted to renounce only the ministry but not the munus, he could not do it. Moreover, Mons. Arrieta affirmed — likewise in his meeting with Br. Bugnolo — that such a renunciation, so as to share the papal dignity with two persons, would be contrary to the Divine law itself.

A Divine obligation for all

Everyone in the Church is obliged to follow the true pope. A man, elected in a Conclave which was convened during the lifetime of a canonically elected pope, is obviously not the pope!  Canon 359 formally forbids the Cardinals to elect another pope during the lifetime of the reigning Pope. And the reigning Pope remains pope until he either dies or renounces in accord with the terms of Canon 332.

If the Clergy has hastily followed the opinion of a journalist or Vatican spokesman who were not qualified in Canon Law, their error obliges no one. If the Cardinals, in haste and without due discretion, presumed the renunciation of ministerium was a renunciation of the papacy, their error obliges no one.  Even if Pope Benedict XVI, with his advanced age, though that he could renounce the power and office of the papacy, without renouncing or even intending to renounce the munus, because he wanted to retain the papal dignity afterwards, this error obliges no one. It obliges no one, because not even Pope Benedict XVI has a power or authority which extends over the papal office.  Only the Creator of that office, Jesus Christ, has that power. Hence, not even the intent expressed in the act (that of vacating the Apostolic Throne) can repair the error of not renouncing the petrine munus.

What are we to do now?

We must insist with our sacred pastors that they stop naming the man, who never received the petrine munus, as  pope in the Canon of the Mass, and return to naming Pope Benedict. Each priest needs to employ canon 41, which gives him the authority to read the text of the Renunciation and to declare it null.

We need to do everything we can to convince the Cardinals to recognize their error and to return their loyalty to Pope Benedict XVI. Finally, we need to insist that the Cardinal Archbishop of Buenas Aires returns home to Argentina.

This is a solemn duty for every Catholic. We can not do otherwise, if we want to attain Heaven, because to obey an Anti-pope is the worst sin of disobedience possible in the Church on Earth.

A 7th Anniversary of shame!

Today is the seventh anniversary of a day that will live in infamy.

A day of wickedness and flippancy.

A day wherein the Cardinals of the Catholic Church showed their utter contempt for:

  1. Pope Benedict XVI
  2. The Catholic Faith in the Papacy
  3. The Canons of the Catholic Church
  4. The Papal Law on Conclaves
  5. Common sense

Let me explain why I say this, point by point, in reverse order.

The Cardinals betrayed common sense 7 years ago today

It is obvious by now, that if anyone on the planet ,who had common sense, sat down and talked to Bergoglio for 15 minutes, he would realize that he is not a fit candidate to be Roman Pontiff.

But the College of Cardinals had been housed together with him for two weeks prior to March 13, 2013.

Therefore, the last 7 years proves that God certainly did not approve of their judgement in selecting such a man. Indeed, it was an epic failure of the College of Cardinals, as I wrote, in 2015.

The Cardinals betrayed John Paul II’s law on Conclaves

The Cardinal Electors violated the papal law on conclaves, in several ways.

First of all, they violated the Law, Universi dominici gregis, as regards the requirement in n. 37, of that law, when they held a Conclave without verifying whether there was a legal sede vacante.

A legal sede vacante means that either the previous pope is dead, and they confirm that with a funeral, or the previous pope resigned according to the norm of Canon 332 §2.

I have it from no less than the Secretary of the Pontifical Council for Legal Texts, Mons. Arrieta, whose commentary on the Code of Canon Law I keep at by desk, that there never was any meeting of canon law experts to verify if the Declaratio of Pope Benedict, of Feb. 11, 2013 — commonly called Pope Benedict’s Renunciation — was in conformity with the norm of canon 332 §2.

Second, the Cardinals violated n. 81, of the same papal law, by entering into agreements and promises to vote for Bergoglio, as Cardinal Daneels of Beglium admitted in his Biography composed of interviews he gave. But the College has never acted on the self admission, which in Canon Law tradition is an indisputable act of self imputation of a canonical crime. I have covered this issue in an extensive Chronology of Events, which still remains the most authoritative collection of facts on the matter, on the net.

Thrid, the Cardinals rushed to elect Bergoglio by violating the same Papal Law on the number of ballots permitted on each day: four, as is specified in n. 63, of the same papal law, regarding limit on the number of ballots to be taken on the 2nd day of balloting and all subsequent days.  Because, as has been confirmed by several testimonies in the last 7 years, Bergoglio was elected on the 5th ballot. And this has never been denied.

Fourth, while there has been much controversy over whether the Cardinals could proceed to a fifth ballot in the case of a 4th balloting which contained 1 more vote paper than the number of Electors present, there remains 2 legal questions which have never been addressed about this:

  1. The Cardinals could not lawfully proceed to a 5th Ballot unless they paused the election and held a discussion on the interpretation of the papal law, using the right conceded to them in that same law, in n. 5, for this purpose. If they proceeded to a 5th ballot without such a discussion and vote, then even if they interpreted it as valid, that omission made their interpretation illicit, and hence the entire election invalid.
  2. Whether the Auditors of the Papal Conclave, as specified in n. 70 of the same papal law, held any meeting or discussion in accord with the norm, there specified, regarding the auditing of the final vote. Because in the case that there was no meeting in accord with n. 5 of the same papal law, in regard to whether to proceed to a 5th ballot when only 4 ballots were permitted, then likewise if the Auditors did not meet, the election was canonically invalid. And if they did meet, they had to declare in the case of the lack of a vote in accord with n. 5, that the election was invalid.

Since the multiple reports about a 5th balloting are all silent about what should have happened as regards nn. 1 and 2, here above, it can be rightfully doubted the election was valid. Because a doubtful pope is no pope.

The Cardinals Betrayed the Canons of the Catholic Church

Seven years ago today, the Cardinals consummated their betrayal of the Canons of the Catholic Church promulgated by Pope John Paul II, in 1983, in the text known as the Codex iuris canonicis, or the Code of Canon Law.

First, the Cardinals violated canon 40, which required them not to take any decision in regard to Pope Benedict XVI’s Declaratio of Feb. 11, 2013, until they had the Latin text in hand in its final corrected version. Since the Vatican Press office in the days following February 11 published at least 3 versions of the text, there is sound canonical evidence that Cardinal Sodano, through Father Lombardi, violated canon 40 in instructing Giovanna Chirri at 11:58 AM, on that morning, to announce to the world that Pope Benedict has announced his resignation from the Pontificate on Feb. 28.  Canon 40 declares invalid any act taken by a subordinate, before he has in hand the integral text of the act of his superior.

Second, the Cardinals violated canon 41, which required them to examine if the legal act contained in the Declaratio was an act specified by the Code of Canon Law and was in all its particulars a command to do something opportune.  But since in the entire Code of Canon Law there is no mention of an act of renunciation of ministerium, the act posited by Pope Benedict XVI was clearly an an actus nullus, and thus canon 41 required them not to act upon it. Also since a renunciation of ministerium does not effect the loss of the papal office, the fact that the Declaratio speaks of calling a Conclave is an inopportune detail or provision. Canon 41 requires that those with mere ministry of execution, in such a case, have recourse to the superior to correct these issues. Once again, according to Mons. Arrieta, nothing of the kind happened.

Third, the Cardinals violated canon 38, which required them not to interpret the Declaratio of Pope Benedict as being in conformity to Canon 332 §2, on the grounds that by naming the ministerium instead of the canonically required munus, the act would gravely injure the rights of the Faithful to know if the pope had validly resigned or not, would cause doubt and risk schism in the Church. For in such a case, Pope Benedict XVI would have had to granted a derogation of canon 332 §2 in his Declaratio, in conformity with canon 38, otherwise the act would have been irritus. He did not, so the act was irritus — a technical canonical term which means having not effect in law, void, on account of having not followed due procedure (ritus).

Fourth, the Cardinals violated canon 36 §1, which requires them to interpret strictly any papal act which violates the norm of any canon, let alone Canon 332 §2. To interpret strictly means that they had to read ministerium as exclusive of any signification of munus, and thus hold that the Declaratio was prima facie incapable of causing Pope Benedict to validly resign the papal munus, the papal office and the papal dignity.

Fifth, the Cardinals violated canons 126 and 188, which require that a juridical act of renunciation of office contain the proper or essential act specified in the law.  As is clear from the Code of Canon Law, which speaks of the Papal Office in canons 331, 332, 332, and 749, the proper term for the papal office is the petrine munus, not the petrine ministerium.  Hence, they were required in accord with canon 188 to judge the renunication irritus on the grounds of substantial error.

Sixth, the Cardinals violated canons 17 and 145 §1, which require respectively that the terms of all canons be understood in their proper sense, that ministerium and munus, when mentioned in any canon be understood thus, and to undertake a study of the entire Code of Canon Law and canonical tradition, in the case of the doubt as to whether ministerium can suppose for munus. They did no such thing in February of 2013, as Mons. Arrieta affirmed to me.

Seventh, the Cardinals violated canon 332 §2, which requires them to recognize a papal renunication only if the Pope renounces his munus, and does so freely and manifests this duly.  But since a good number of the Cardinal Electors were present in the Consistory of Feb. 11, 2013, they heard with their own ears that he made errors in Latin and that he said ministerium not munus, in the crucial core section of the Declaratio. They also heard him say munus twice before that. So they had indisputable canonical evidence that the Pope knew what he was doing, knew how to distinguish munus from ministerium, and did NOT intend to renounce his munus.

The Cardinals violated the Catholic Faith in the Papacy

Seven years ago, today, the College of Cardinals violated the Catholic Faith in the papacy. First, in the strict sense of the Faith, namely, that there can only be one pope. Because, it was clear already by March 3, 2013, that Pope Benedict XVI by his own decision was going to retain the papal dignity by using the title “Pope Emeritus”. There was at least one scholarly refutation of the validity of this published on March 3, 2013 by Father Gianfranco Ghirlanda, S. J., former rector of the Pontifical Gregorian University at Rome. So they could not be ignorant of the fact. The same canonical scholar that week affirmed that a heretical pope loses office immediately. So in choosing an obvious heretic as Pope they also violated the Catholic Faith.

The Cardinals showed their utter contempt for Pope Benedict XVI

Seven years ago, today, the Cardinals consummated their utter contempt for Pope Benedict XVI, in that they responded with glee at his renunciation, and not with consternation and respectful attempt to dissuade him from it.

As reported in the press, in February of 2013, only one Cardinal, Cardinal Pell went on record as saying that the resignation should not happen. He said this before Feb. 28, 2013. He was also the first Cardinal the Vatican allowed to be prosecuted after February of 2013. Hmm.

Respect and reverence for the Holy Father, especially when frail and aged, requires first of all that the Cardinals assist him in executing his will, not obstructing it nor allowing it to be executed in an invalid manner.

Yet it also requires, out of gratitude, that they attempt to convince a good man not to resign. If they omit that, they are basically saying he is not a good man or that they despise him.

And they showed their contempt, not only in sentiment, but by positive canonical ommissions, in seemingly in several ways, because in February of 2013 none of them were under a pontifical secret, yet in 7 years they never have confirmed — to my knowledge — in any interview that they did not do the following:

  1. They did not ask Pope Benedict to explain to them why he made his decision or what it meant, to make sure he was resigning freely.
  2. They did not ask Pope Benedict to correct the 40 errors in the Latin text which he read, before it was published, so as to prevent the shame of such a thing staining the last act of his papacy and the Apostolic See.
  3. They did not investigate or question Archbishop Gänswein and those around the pope as to the circumstance of the act to be certain that he was not manipulated or coerced.
  4. They did not ask one another what they knew about the matter. If so, they would have discovered that Pope Benedict did not seek the counsel of others (according to Archbishop Gänswein) or refused the counsel of his better advisers (according to Archbishop Gänswein and Cardinal Brandmuller). If they had done this, they would have been altered to the necessity to examine the act further.
  5. The consummated their disrespect through all these things and for not treating the Holy Father with that due respect for an aged man, in which one presumes frailty and therefore double checks everything to make sure it is done rightly.

Conclusion

For all these reasons, I think it can be said, objectively, that today marks the 7th anniversary of a day which will live in infamy in the history of the Church until the end of time and for all eternity. The Cardinals gravely failed in their duty as Cardinals and as Electors and as Bishops and Catholics. They failed also deliberately and by omission. Their failure also was canonically imputable, since the Code of Canon Law holds as presumptive, the responsibility of men with such high office to know the law and follow it.

Hence, it is objectively and canonically certain, that Bergoglio is not the pope. Because a man whose claim to the papacy is vitiated by so many canonical doubts, is not the pope, according to the ancient maxim of St. Robert Bellarmine, S. J.: a doubtful pope is not the pope.

Advice for priests in Italy during the national Quarantine

The Church in Italy has a special status and independence, granted to it in the Lateran Pact and subsequent accords. Thus, there was no legal basis for the Bishops’s Conference to say anything about the Mass and Sacraments. They chose, however, to seemingly order that they not be celebrated so as to comply with the governmental decrees aimed at limiting the spread of the Corona virus.

However, what the decrees do permit are the opening of restaurants and bars from 6 AM to 6 PM.

I do not know how those who live in Rome without a kitchen can eat dinner if the restaurants are closed at 6 PM! But I have seen Bars and eateries of smaller sizes still open after 6 PM.

However, a priest I think has sound legal basis to work around the government restrictions without violating them.

And he can do it this way:

Open the Church and organize your ministry as a Restaurant or Bar. That is, offer Communion to Catholics as they come in, upon request, without holding any ceremony.

Print out several hundred flyers which instruct the faithful as to which prayers they should say before receiving, where to go to receive and how to receive in a sanitary fashion.

Have a priest stationed in a side altar for 12 hours. He can have a collection basket too, if he wants. He should be properly vested and be at an altar with a Tabernacle and be provided with several ciboria with sufficient Hosts.

Since no amount of the faithful will come at any one time, and since there will be no service, I think there will be no violation of the Decrees: which are aimed solely at groupings of several individuals, not the distribution of things which are eatable.

Require that all receive kneeling and in the mouth, with heads titled back. Do not give the Sacrament until the communicant puts himself in the proper position. Give instructions. Practice with unconsecrated hosts, if need be.

This method can be used for the Sacraments of Penance, Baptism and Marriage. Use simplified rituals. And a lot of common sense.

If a priest needs permission, ask your Bishop. In cases of such grave necessity, I think a priest does not need permission, however, seeing that the Bishop’s conference has totally abandoned its pastoral duty, each priest now is authorized to act as best he sees fit.

Just as it was an act of infinite Mercy that the Son of God should descend from Heaven to save us, so it is an act of the greatest mercy to proclaim the truths and confidence of our Holy Faith in this world of darkness and sin.

There are many ways of doing it. Be creative.

There is a lot more behind the rejection of Pope Benedict XVI, than meets the eye

One of the things which has caused more speculation and dismay among the faithful, in the last 7 years, is the apparent ignorance of every canonical, doctrinal, moral and sacramental deviation in the Church by the worlds Bishops and by the Cardinals of the Roman Church.

Indeed, as anyone who can read can see immediately, that Pope Benedict XVI renounced the ministry but the Code of Canon Law requires a renunciation of munus, means that his renunciation is prima facie invalid, doubtful and not to be accepted.

Wherever I go, and to whomever I speak, who does not get a salary from the Church or hold an office in any ecclesiastical institution, when I point that out, they all agree with me. An idiot can understand it.

But the Cardinals and Bishops and so many priests — AT LEAST IN PUBLIC — do not want to understand it nor show that they understand it.

According to the teaching of Saint Thomas Aquinas, there is only one power capable of preventing the human intellect from seeing the truth of things, according to their essences: the human will. Only if your will intervenes and stops the act of the intellect, can you pretend that ministerium means munus, that they are not different and that renouncing the one is renouncing the other. This is because the intellect naturally distinguishes things which are different.

Saint Thomas calls this intervention of the will an act of violence, because it is contrary to the nature of the intellect not to think and recognize things for what they are.

The spirit which inclines the Cardinals and Bishops to act is becoming more and more clear. We ignored the obvious expression of it in the days immediately following Feb. 11, 2013: the glee to see Benedict go.

In a recent email exchange of a friend with a priest, on the topic of Benedict’s renunciation, the priest responded:  THANK GOD HE IS GONE!

He did not specify which god he was thanking.

With the rituals in the Vatican Gardens and at the Vatican adoring Pachamama, at which Cardinal Sarah and numerous Bishops and priests ares said to have been present with Cardinal Bergoglio, we can see more clearly what spirit is behind that glee.

Amoris Laetitia, Laudato Si’, and Querida Amazonia also show what spirit is.  But it is shown more clearly to those who do not read long documents, in this, that the Bishops are ordering the cessation of the Mass and Sacraments for all the faithful in diocese after diocese.

This is complete apostasy. If you do not want to call it apostasy, then I think you are doing violence to your intellect.

Discerning spirits

If we take a look back on the last 60 years in the Church, we can see distinctive indications of this spirit. The elimination of the mention of the Devil, Hell, Damnation, the immorality of the Soul, the Judgment of the soul after death.

Many of us lamented these deficiencies in the Aggiornamento as a secular trend. But I think that judgement was superficial. There is nothing in this wold which is secular. It is either of God, or of the Devil.

And men who do not chose God, are held fast in bondage by the lord of darkness.

The whole purpose that the Son of God descended from Heaven was to liberate us from the power of Satan. His public ministry was a ministry of exorcism and healing those who were afflicted with disease and death, signs and effects of bondage.

The denial of His miracles and His exorcisms and His preaching against Hell and damnation, and its causes, disbelief and immorality, all had a purpose.

And there is no spirit which hates the liberation from damnation, sin, immorality and bondage to the Devil but one.

And if you cannot name that spirit, then I think you are also doing violence to your intellect.

That spirit is the true Lord of Bergoglio. That is the true god he serves. That is why he will not bend his knee to the true Incarnate God. And that is why both he is demanding the abolition of the Holy Sacrifice and why the Bishops are readily complying without question.

They won’t say so in public, because that is how devils work. The Saints call the Holy Angels spirit of light. The devils are called spirits of darkness. You do not see what they do, because they are all about omitting the right things to be done. And it is hard to notice what is not there.

The Greek Orthodox Church refuses to suspend Masses

Drawing from its rich liturgical history and the teaching of its Saints, the Bishops of the Greek Orthodox Church in Greece have refused calls to suspend liturgical functions. The official statement rebuts the claim that the faithful can contract Corona Virus while receiving the Most Holy Communion in the Greek Rites.

Palestrina: Missa in duplicitus minoribus

Today we begin our perusal of the sacred repertoire of  Giovanni Pierluigi da Palestrina, the greatest Italian composer of the 16th century, whose fame has never been extinguished. He came to Rome in 1537, when he began as a cantor at Santa Maria Maggiore, and 14 years later he was in the service of Pope Julius III, who was also from Palestrina.

Today, we sample his Missa in duplicitus minoribus, or Mass in a double minor, for 5 voices.

Does Skojec know the Most Blessed Sacrament is the God of Life?

There comes a point in every profession that one must speak about the criteria for professional incompetence.  I will just leave it at that.

Another reason that laymen are not the best suited to explain the Faith on social media.

But for those who do not know their faith, the One who is the Most Blessed Sacrament is the Lord and Creator of All, the giver of life and the source of all Healing. He is also the Judge of all.

If you are in the state of grace, then have no fear whatsoever of receiving the Sacrament, even in the time of plague. Because your faith will merit your salvation, and we are not made for this world, but for life in the world to come.

This is simplicity of heart. If you think God the Father gives diseases to those who receive His Son, you are simply an atheist and blasphemer. And if you think He will not reward those who trust in His Son, then you are an infidel.

Likewise, if you are looking to escape every cross, then you have not yet showed supernatural faith in Christ’s crucified! Better to place ourselves in the hands of God than in the hands of doctors and scientists, who have never saved anyone from physical death, let alone eternal damnation.

Here we need to make distinctions. There is no Saint in the Church who fled from a plague. There are many Saints who helped the sick and risked death, some of whom died of the plague, others whom did not. The Saints did not flee, because by faith they knew that we are to live for God. Period. Whatever befalls us, God is in control.

Saint Bernardine of Sienna assisted his fellow townsmen in the plague. He was lambasted by relatives for it. And some of them died of the plague. But he did not. He went on to be one of the greats saints of Italy who called the Italian people back to the Faith in the 15th century.

Even though there is not the obligation to give the sacraments which do not pertain to eternal salvation during the time of a plague — Saint Alphonsus teaches this in his Theologia Moralis — a priest will be damned if he refuses the Sacrament of Penance to sinners during a plague. Likewise, the Sacrament of Baptism. This is because it is a grave duty of the priestly dignity to save souls. And to refuse the positive means of salvation to any soul, so as to save one’s own life from a possible risk, is a mortal sin against both charity and the priestly duty.

But, medically we know there is minimal risk of death from the Corona Virus. The mortality rate of those who end up in hospitals, who are only a tiny fraction of the entire population — most of whom when they contract Corona virus have no or few symptoms — is only 3.4%. So for the entire population it is less than perhaps a half of a percent. And these are all individuals with bad states of health, except for a very few. So Corona virus presents no real threat to anyone with normal health, more than the normal influenza which kills more people each month in the world, ever year, than the Corona Virus has ever killed ever. This observation is confirmed by a Vanderbilt Doctor.

For that reason, those who act disproportionally are not acting rationally. Most of all when they discount God Himself present in the Eucharist! This is simply atheism. And shows that some persons have very little faith or sense. Remember, God created viruses. They serve His will to punish sin and sinners and give the just means of meriting eternal life. This does not mean that we should be deliberately careless, but it does mean that we should take God as our surety and trust in Him. He is the First Cause and our last End. Nothing can happen to us unless He wills it. Confess your sins and live ever as His trusting servants and friend. And certainly do not let hypochondria lead you to omit the Sacraments, if you are in the state of grace.

Italian Bishops excommunicate Italians, praise China

Silence is tacit consent. But praise is explicit approval.

Catholics from all over the world found it incomprehensible that the Vatican would sign an accord with the Marxist tyranny of China that would require Catholics in China to embrace heretical and schismatic clergy of the patriotic Church and call them “Catholics”. But so much has that accord changed things, that in the letter denouncing Cardinal Zen of Hong Kong, Cardinal Re, the Dean of the College of Cardinals implied that whereas before the independent Church in China was that of the government, now the clandestine Church — the illegal one — the Vatican recognizes to be the Catholic!

The implications of all of this are that the Catholic Church has been taken over at its summit by Marxists and that they are fully aiming to do to the Church what China did to the Church in China.

It seems a preposterous inference. But daily events are proving it true! Now any Catholic priest in Italy can be arrested for the crime of saying Mass in public. Baptisms, Marriages, Confirmations, even funerals for the dead are also illegal. Or so the Bishops’ Conference would have you think.

And the Bishops will let them be arrested! They have banned the Sacraments, in attempt to give force to a governmental decree from which the Church is immune by law!

This was a decision of the Catholic Bishops’ Conference of Italy, which has NO authority in Canon Law or civil law to give orders to anyone!

But in Italy there is a Lateran Pact, which the Popes since Pius XI have used to defend the liberty of the Church in Italy.

Yet at the emanation of the decree of the left wing Government here in Italy: silence. No opposition. And indeed, approval.

This can be seen in today’s issue of the Avvenire, the official newspaper of the Italian Bishops’ Conference. Article after Article tells the reader to comply with the government, accept that there are no more masses. Watch the mass of Bergoglio on the internet!

And no word on who made the decision to order the Bishops and clergy of Italy to stop public services. How like the  Marxist Party!

The alliance of the Bishops with China in persecuting the Church seems complete. Even the Avvenire, while counseling acceptance of having no Sacraments, praises China for having come out of the darkness of the stigma of having the Corona Virus. Now everyone has it! No more  anti-Chinese prejudice!

Is not that what Christianity is all about?

The Suspension of Masses is a Bergoglian objective

Riccardo Cascioli is right, there is an air of China now in Italy. Because the Catholic Religion has effectively been suppressed by the Catholic Bishops’ Conference just as it is suppressed in China.

Except that in China there is more religious liberty, in that they have still their public religious services in most other religions!

Everyone knows this will to suppress masses has come from Santa Marta.

Italy has a special legal relationship with the Catholic Church, founded upon the Lateran Pact: a treaty between the Apostolic See and Mussolini which originated the special legal status of the Church in Italy.

In all questions of the meaning of that relationship, the Bishops Conference of Italy defers to the Vatican. Legal Scholars are speaking out: it is clear that the decrees of the Italian government regarding the suspension of all public religious services cannot be understood to apply to the Catholic Church, which in Her own churches is free of all government control in matters of religion.

Thus, what is this will to suppress the Mass and Sacraments? Whence does it come?

I think the answer lies in the admiration that Jorge Mario Bergoglio has for the People’s Republic of China. Several of his ecclesiastical pawns have even gone so far as to praise China as the perfect embodiment of Catholic social teaching.

So, let us figure:

In China the Catholic Church is suppressed. And this is the perfect expression of Catholic Social Teaching.

Therefore, to have the perfect expression of Catholic social teaching, in Italy, you need to …

I think you can finish the comparison.

But obviously, “Catholic social teaching” in the mouth of Bergoglio does not mean what it means in the mouth of Pope Leo XIII.

I predict, not as a prophet, but as someone who has closely observed the modus operandi of Bergoglio, that the suspension of the Sacraments will continue indefinitely.

But when the Government approves, Bergoglio will order the practice of new religious rituals in the churches of Italy, ones which mix things from all the religions of the world. This is the objective of the Abu Dahbi statement. This is the objective of the Amazon Synod. Thus, one must presume it is also the objective of shutting down the Church in Italy, when the Lateran pact gives the Church the right to do the exact opposite.

Conte is leading Italy into chaos

I met a taxi driver yesterday who knows more about government that the Italian Premier (Prime Minister), Giuseppe Conte.  When I asked him what he thought about the new Decree to prevent the spread of corona virus — which came out on Saturday night — he said it is easier to issue a decree than solve the problem, because solving the problem took money and whits.

As an anthropologist, not a prophet, I foresee disaster in Italy. The break down of law and order. For the same reason: you cannot effectively respond to an epidemic through decrees.

Common sense recognizes that a virus is a living organism which does not respect decrees. Coronavirus 19, because it does not cause symptoms or problems in most persons, who are used to having influenza now and then, will thus spread rapidly to everyone in Italy. It is simply a mechanism of life. There is no way to shut down human life by decrees that will prevent it.

Consequently, as the death toll rises astronomically, the exasperation of the people will also rise. They will see that these draconian measures do not work. And since Italians are first and foremost lovers of human beings, they will begin to nurture the most profound anger for the authorities which are denying them the Sacraments and the opportunity to visit loved ones in their time of need, be with family members — the new decree effectively imprisons everyone in the Region in which they live and forbids egress and ingress — and attend the public funerals of loved ones — here funerals are magnificent events where thousands come out to mourn the passing of not a few citizens of each town.

Anthropologically what Conte is doing is unsustainable. It will be biologically ineffective. And from the point of the police forces in Italy, it will be impossible to enforce.

The result will be a breakdown of law and order. And it has already begun. Because the new Decree in denying visits of spouses and girl-friends to prisoners has caused 22 Prison Riots in the space of 48 hours. A thing unheard of in Italian history!

Bl. Ann Catherine Emmerich in her mystical visions of 1820 for the city of Rome saw that there will come a time with a violent mob will sweep the city wrecking destruction everywhere.

We are about to see that happen. Not today, or next week, but perhaps by the end of spring.
