This is a great video on the inherent human right of free speech, but it neglects that we have also an inherent duty to say the truth. If we subsume the entire relationship of citizen to state under “freedom of speech” we can never find a solution or balance between individual liberty and state power. Only by understanding the nature of man as made in the image and likeness of God and the limitations on state power as existing to defend the innocent from the malicious, can we arrive at a true concept of what forms of expression (malicious, dishonest, mendacious) are truly immoral and what forms could become criminal (threats of grave harm).

Contrary to what this woman says in the video above, even in the U.S.A. there is a problem with the concept of free speech. For, if a husband threaten his wife with murder, nothing can be done, so long as he does not physically harm her, even though it is clear he intends to. And this raises the issue that the State cannot protect all citizens from all harm and that there needs to be subordinate authorities down to the family level who have the right and duty to intervene.

The modern state dissolves all relations of family and tradition, culture and local societies, to prevent this.

And thus its appeal to “freedom of speech” is really just a slogan, the meaning of which depends on subjective ever-changing definitions.

For example, if you are a political candidate of the GOP or Democrats in the USA and receive a phone call threatening your life, it is immediately investigated by the police. But if you are a candidate from any other party, you are told to tolerate such threats as part of the political process.

So in truth, when there are unchecked and unrestrained power structures in a system of law where there are no rights but those written (juridical positivism), then there is only freedom of speech for those in power.
